Capital Case Attorney Fee Council
The Capital Case Attorney Fee Council meets annually to review the compensation rate for lawyers who represent indigent defendants in death penalty cases.
The current compensation rate is $125 per hour to be paid to counsel at all stages of an indigent defendant’s representation in a capital case, with no cap or limit. Compensation is to be paid on a quarterly basis or more frequently as ordered by the court upon proper submission by counsel of all required paperwork.
In 2016, the Capital Case Attorney Fee Council was established pursuant to R.C. 120.33(D). The Council determines the compensation rate and makes recommendations of any changes to the Office of the Ohio Public Defender. The rate is unchanged since the Council was established.
The Council is comprised of five appellate court judges, appointed by the Chief Justice of the Supreme Court of Ohio. Members serve three-year terms unless they cease to be an active court of appeals judge.
