Commission on the Rules of Practice & Procedure
The Commission on Rules of Practice & Procedure is established by the Supreme Court to assist the Court in exercising the rule-making powers granted in Article IV, Section 5(B), of the Ohio Constitution. The Commission is responsible for reviewing all rules governing practice and procedure in Ohio courts, receiving and considering proposed rules or amendments, and recommending rules and amendments to the Supreme Court.

Submit a proposed amendment to the Commission on Rules of Practice & Procedure
The Commission on the Rules of Practice and Procedure invites public input at their next regularly scheduled meeting on Friday, June 9, 2023, at 10 a.m., relative to possible amendment of Ohio Crim.R. 33. The Commission meeting will be held in the Reading Room of the Law Library at the Thomas J. Moyer Ohio Judicial Center, 65 South Front Street, 11th Floor, Columbus, Ohio 43215.
Those interested may attend in person or by ZOOM, if pre-registered by May 26, 2023. Oral presentations are limited to 10 minutes (exclusive of questions from the Commission) for those pre-registered, to allow as many participants as possible. Those submitting written comments are strongly encouraged to do so by June 2, 2023, whether or not they plan to attend or offer an oral statement at the meeting.
The Commission is considering adoption of a substantially changed Rule 33 of the Ohio Rules of Criminal Procedure, or a new Rule 33.1. Together with several Ohio statutes, Crim.R. 33 addresses the procedure for motions for a new trial in a criminal case.
The background for this examination is the series of recommendations by the Ohio Supreme Court Task Force on Conviction Integrity and Postconviction Review, released in July 2022. A new Crim.R. 33.1 draft was proposed by the Task Force and was circulated for public comment earlier this year by this Commission. The comments submitted will be considered by the Commission without the need for new or duplicative submissions; non-duplicative and supplemental input is invited in June.
