11th District Judge Hears Supreme Court Case
Judge Diane V. Grendell of the 11th District Court of Appeals served as a visiting judge on the Supreme Court of Ohio today and heard oral arguments in a Tuscarawas County case.
Judge Grendell was selected by Chief Justice Thomas J. Moyer to sit in place of Justice Robert R. Cupp,who recused himself from Erwin v. Bryan (Case No. 2009-0580).
According to the Ohio Constitution, in the event of a recusal by a Justice, the Chief Justice of the Supreme Court can select any of the 69 sitting Ohio appellate court judges to sit temporarily on the Supreme Court.
“We are pleased to have Judge Grendell join us today,” Chief Justice Moyer said. “Her participation provides the parties in the case with a court of seven justices despite the recusal of Justice Cupp.”
The Erwin case involves the statute of limitations in medical malpractice actions.
Judge Grendell, who served as a state representative to the 68th District before taking the bench, was elected to the appeals court in 2000. She is a member of the National Civil Justice Taskforce Committee and the Public Confidence and Community Outreach Committee for the Ohio Judicial Conference. Judge Grendell received her law degree from the Cleveland-Marshall College of Law at Cleveland State University.
The 11th District Court of Appeals serves Ashtabula, Geauga, Lake, Portage and Trumbull counties, and hears cases from county, municipal and common pleas courts as well as original actions in habeas corpus, mandamus, prohibition, procedendo and quo warranto.
