Second District Judge Hears Supreme Court Case

Judge Jeffrey E. FroelichJudge Jeffrey E. Froelich of the Second District Court of Appeals served as a visiting judge on the Supreme Court of Ohio today and heard oral arguments in a Cuyahoga County case.

Judge Froelich was selected to sit in place of Justice Maureen O’Connor,who recused herself from Berry v. Javitch, Block & Rathbone, LLP (Case No. 2009-1507).

According to the Ohio Constitution, in the event of a recusal by a Justice, the Chief Justice of the Supreme Court can select any of the 69 sitting Ohio appellate court judges to sit temporarily on the Supreme Court.

The Berry case involved whether a plaintiff must return compensation from a settlement agreement before seeking damages for fraud.

Before his election to the appeals court in 2008, Judge Froelich spent 14 years on the Montgomery County Common Pleas Court bench and 16 years on the Montgomery County Court bench. His public service career has also included time as a Montgomery County assistant prosecutor. Judge Froelich earned his law degree from the University of Michigan.

“I greatly appreciate the appointment as a visiting Justice, and I am honored by this opportunity to serve on the Supreme Court,” said Judge Froelich.

The Second District Court of Appeals serves Champaign, Clark, Darke, Greene, Miami and Montgomery counties, and hears cases from county, municipal and common pleas courts as well as original actions in habeas corpus, mandamus, prohibition, procedendo and quo warranto.
