Case Details Announced for
Supreme Court Ohio Northern Session
The Supreme Court of Ohio today provided detailed background information on the four cases it will hear at Ohio Northern University on Wednesday, Sept. 29, as part of its semiannual Off-Site Court program.
Oral arguments will be held before the seven Justices of the Supreme Court at 9 a.m. in the Ohio Northern University Moot Courtroom, Tilton Hall, 415 S. Gilbert St., Ada. Chief Justice Eric Brown will preside and be joined by Justices Paul E. Pfeifer, Evelyn Lundberg Stratton, Maureen O’Connor, Terrence O’Donnell, Judith Ann Lanzinger and Robert R. Cupp.
The cases include:
- State v. Cook, Case No. 2009-2122 (Lucas County). The Cook case concerns two conflicting appeals court rulings about a state statute that sets forth certain circumstances under which the time limit for prosecuting a crime is tolled.
- State v. Calhoun, Case No. 2009-2324 (Cuyahoga County). The Calhoun case concerns whether the principle of double jeopardy prevents trying a defendant on an aggravated murder charge based on a specification from an earlier attempted murder incident.
- Allstate Insurance Company v. Campbell, Case No. 2009-2358 (Franklin County). The Allstate case concerns under what circumstances a trial court can infer that a policyholder acted with intent to cause injury.
- Campbell v. City of Carlisle, Case No. 2009-0209 (Warren County). The Campbell case concerns whether a court should consider a reduced tax rate based on agricultural use in an action to detach property from a city.

Initiated in 1987, the Off-Site Court program has gained national recognition as a model program for education about the judiciary. The program enhances students’ understanding of the legal system by providing them an opportunity to attend and observe the proceedings of the Supreme Court in person and to interact with Justices, attorneys and Court staff.
Students from ONU’s law school and Ada, Hardin Northern, Kenton, Ridgemont, Riverdale and Upper Scioto Valley high schools will participate. The students and their teachers will receive curriculum materials to study before the session, including summaries of the specific cases to be argued. Local attorneys will team with educators at each participating school to explain Ohio’s judicial system and review case materials.
Students from each participating school will attend one of the oral arguments. After their assigned case has been argued, each group will meet with the case attorneys for a debriefing and discussion of the legal issues in the argument they just heard.
The ONU session will mark the 60th time the Supreme Court has heard oral arguments outside Columbus during the past 23 years.
