Simulated Trials Part of Upcoming Orientation for New Magistrates

In addition to new judges recently elected or appointed who are beginning their terms this year, first-time magistrates will join them on the bench to alleviate the caseloads.

The annual three-day new magistrate orientation, which will be held in April, will help acquaint new magistrates with the variety of areas of law and procedure that might be new to them. The training utilizes simulated trials during which new magistrates test their courtroom abilities in a challenging yet supportive environment. Experienced magistrate faculty will lead new magistrates through pre-determined scenarios and discuss the right way and wrong way to handle issues.

The instruction includes professionalism and ethics courses to meet the magistrates’ continuing legal education requirements and breakout sessions with issues specific to the court of practice: common pleas, domestic relations, juvenile, municipal and probate. Other topics include the Rules of Practice and Procedure, maintaining control of the courtroom, decision writing, ruling on objections, effective communication and hearsay.

Besides the traditional education topics, Phil Schopick, education program manager for the Supreme Court’s Judicial College, said another important aspect of the orientation is the opportunity for new magistrates to meet, talk to and ask questions of experienced magistrates. “The value of having an in-depth conversation with someone who’s been in your shoes cannot be overstated,” Schopick said. “We encourage new magistrates to take advantage of these one-on-one discussions as much as possible.”

Created in 1976 and governed by Gov. Jud. R. V, the Judicial College was established to provide educational programs and activities for Ohio judges. In 1988, the program was expanded to include court referees and magistrates, and in 1990 the college began to provide programs for non-judicial court personnel throughout the state.
