Supreme Court Increases Filing Fees
The Supreme Court of Ohio today announced the adoption of an amendment to the Supreme Court Rules of Practice that increase fees to file a case in the Supreme Court to $100. The fee increase takes effect Oct. 16, 2009.
Rule XV of the Rules of Practice will require a $100 filing fee for filing a notice of appeal or cross-appeal, for filing an order certifying a conflict in a court of appeals, and for instituting an original action. Currently, the Revised Code and the Rules require a $40 filing fee for these actions. The General Assembly included the change in filing fees in the 2010-2011 budget bill. The Justices concurred 7-0 in adopting the amendment.
Supreme Court Clerk Kristina D. Frost said the $40 fee has been in place for nearly 20 years. She also noted that the Supreme Court’s filing fees are among the lowest in the nation for state courts of last resort. Filing fees in other states reach as high as $655 in California and $550 in Minnesota.
Original actions also require a $100 security deposit, which is unchanged by the new amendment. Filing fees and security deposits are waived for those who file an affidavit of indigency with the Supreme Court.
The rule amendment announced today conforms with the provisions contained in the budget bill.
